Term agreement
Terms and conditions of use - Updated March 23, 2016
The following terms and conditions of use constitute legal obligations between you and Conestoga College Institute of Technology and Advanced Learning (referred to hereafter as “Conestoga”) for the Conestoga ONE Card (referred to hereafter as “ONE Card”). The use of the words “you” and “your” denote the person named on the ONE Card. The ONE Card is governed by these terms and conditions and Conestoga policies, procedures and regulations, so please read carefully.
By obtaining a ONE Card, depositing funds into your ONE Card account or by using ONE Card services, you agree to and accept all of these terms and conditions. The terms and conditions are subject to change from time to time and without notice. Future changes will apply to all ONE cards in circulation and will supersede the previous terms and conditions in effect at the time you acquired your ONE Card. Be sure to review the terms and conditions regularly and adhere to the Agreement and Terms and Conditions of Use at all times.
Use and ownership
The ONE Card and the related photo of you are the property of the Conestoga. They are used by Conestoga employees, contractors and ONE Card service providers to identify you as a Conestoga student or employee and provide you with access to various services. You must present your ONE Card upon request by Conestoga or its service providers. If requested by Safety and Security you must surrender your card. If there are funds on the card and the card is not returned to you a refund process will be initiated.
You are the only person entitled to use your card. The ONE Card is non-transferable. You may not use your ONE card for any illegal, improper or unlawful purpose, for example, presenting your ONE Card as evidence of being a student or alumni at Conestoga when you are not. Using the ONE Card of another person, or altering, falsifying or selling a ONE Card are prohibited.
Condor Cash is a declining balance monetary account available on your ONE Card that can be used for taxable purchases such as vending machine, bookstore, printing and food purchases. You may deposit funds to your Condor Cash account through the web or in person at our bookstores and ONE Card Office.
You may use your ONE Card for purchases where accepted by ONE Card service providers, provided funds are available in your account. The purchase of alcohol, tobacco products, gift cards, lottery or any other item deemed inappropriate by Conestoga is prohibited. The ONE Card does not provide credit. Cash-back transactions are not permitted. Conestoga reserves the right to deduct any outstanding balance on your student account from any refund of ONE Card funds you may receive.
You are responsible for use of the ONE Card, including transactions made as a result of misuse of your ONE Card. If you have problems with anything you purchased using your ONE Card, you must attempt to settle the problem directly with the service provider. In some circumstances, Conestoga may be able to provide assistance in resolving disputed or declined transactions (see Charge dispute section).
Security
You are responsible for safeguarding your ONE Card against loss or theft, for maintaining it in proper working condition and for keeping your online account login confidential. Conestoga will not ask you to divulge any of your access information.
Lost or stolen ONE Cards
If your ONE Card is lost or stolen, you must immediately deactivate it. You can do this online, in person at the ONE Card Office or by calling the ONE Card Office. An email or voice message does not constitute proper notification for lost or stolen cards due to time delays.
You are responsible for all transactions made on your card until it is reported lost or stolen. Conestoga is not responsible for funds or services used with a lost or stolen card. In the event that the online service to deactivate your card is unavailable, Conestoga is not responsible for transactions on your ONE Card. You will not be responsible for transactions occurring after you deactivate your ONE Card.
A $25 fee is charged for replacement cards. Your account will be reactivated only after the replacement fee is paid, your student status has been verified, proof of identification presented and a new ONE card has been issued. Once a replacement ONE Card has been issued, your remaining cash balances will be transferred to your new ONE Card. After a ONE Card is deactivated, it can only be reactivated at the ONE Card office with proof of identification, and only if a replacement card has not been issued. Once a new ONE Card is issued, any previous ONE Cards are permanently deactivated.
If your ONE Card is found and returned to Conestoga, the ONE Card Office will contact you through your college email.
For verification purposes, students will be requested to show a piece of Government-issued photo identification when picking up a replacement card.
Inactive ONE Cards
After five years of inactivity from the last transaction, all fund balances on a ONE Card become the property of Conestoga. Access to some services on campus is tied to your full-time student status. If you are no longer registered as a full time student, some services may not be available to you.
Charge disputes
If you are not able to successfully resolve a purchase disagreement with a service provider and you wish to dispute the charge deducted from your ONE Card account, you must notify the ONE Card Office in person within 30 calendar days of the date of the charge. You must provide the date, location and amount of the transaction, along with any other information that may help staff resolve your claim. Disputing a charge does not necessarily guarantee that the disputed charge will be credited to your ONE Card account. Charge disputes are dealt with on a case-by-case basis.
Statements & account balances
You can access your account history and current balance information at any time at onecard.conestogac.on.ca.
Currency
All ONE Card account funds are in Canadian dollars. All deposits made to your card account at the Conestoga bookstores, ONE Card office or on-line must be in Canadian funds. The intended amount of deposits made using a debit or credit card outside Canada may not be equivalent to the amount actually deposited due to currency exchange rates.
Refusal to accept or honour a ONE Card as payment
Conestoga is not responsible for refusal by a ONE Card service provider to accept or honour your ONE Card for whatever reason, including the following:
- There are insufficient funds in your account at the time of the purchase
- Equipment normally used to process the transaction is not functioning
- Your account is temporarily suspended or cancelled due to a violation of these terms and conditions
- Your card has been reported lost or stolen
- Your card picture is not adequate to identify you and you were not able to provide alternate identification
Refunds
Funds deposited into the card holder account are the responsibility of the card holder and become property of the card holder upon deposit. The ONE Card Office will process a refund request upon receipt of a completed refund request. Please email us at onecard@conestogac.on.ca to request a refund.
To process a refund request, the card holder’s ONE Card account will be suspended until the refund request is complete.
All refund requests are subject to $50 administration fee that will be deducted from the ONE Card account balance prior to any refund being issued.
Refunds are limited to one refund per term. Conestoga reserves the right to deduct any outstanding balance on your student account from your refund. Refunds may take up to four weeks before they are received.
Confiscation of ONE Cards
Any Conestoga employee or ONE card service provider may confiscate your ONE card if you use it fraudulently, without authorization or for improper purposes. Once a ONE Card is confiscated, it is sent to the ONE Card Office. If your card is confiscated, you will be required to use another payment method to complete transactions.
Collection and use of your personal information
Personal information required to produce the ONE Card is collected, used and disclosed under the legal authority of the Ministry of Training, Colleges and Universities Act, R.S.O. 1990, the Ontario Colleges of Applied Arts and Technology Act, R.S.O. 2002, and regulations thereunder. At all times it will be protected in accordance with the Freedom of Information and Protection of Privacy Act. Individuals who are applying for a ONE Card acknowledge the above and consent to the collection, use and disclosure of personal information, including the digital images used to produce the ONE card.
Your personal information is intended to be used to verify your identity, to operate your ONE Card through payment card networks and for the purpose of and those consistent with providing the services associated with the ONE Card.
Your digital photograph will be printed on the front of your ONE Card and will be stored in the Conestoga databases. All photos used for the ONE Card, including those submitted by you, are Conestoga property and may be shared with Conestoga employees, contractors and ONE Card service providers to identify you as a student or employee at the Conestoga. Your ONE Card transaction information may be shared with payment processors associated with ONE Card transactions in connection with detecting, investigating and preventing fraudulent ONE Card transactions and in connection with risk management and security purposes or with confirming deposits onto your ONE Card.
Questions regarding the collection and use of your personal information for the ONE card should be addressed to the ONE Card Office.
Limitations on the Conestoga liability and indemnity
Conestoga is not liable to you for any loss, inconvenience to you or to others, or any damages (including special, indirect or consequential) or expenses of any kind that may result from the use or misuse of the ONE Card, or if, for whatever reason, your ONE Card is not accepted or you do not have sufficient funds in your account. You agree to indemnify Conestoga and save it harmless from all liability, all manner of actions, causes of action, suits, claims, demands, expenses and costs whatsoever which may be brought against or sought from Conestoga because of, arising out of, in connection with or in relation to the use or misuse of the ONE Card.
